Modern Memoir provides cinematic memoir films and related creative services. Submitting an inquiry does not guarantee availability, acceptance, or booking.
All services, pricing, timelines, deliverables, and project details will be confirmed in writing through a proposal, invoice, or agreement. Modern Memoir reserves the right to accept or decline projects at its sole discretion and to define the scope of Services.
6. Payments, Fees & Refunds
Payment terms, including deposits and balances, are provided at the time of booking. Unless otherwise stated in writing:
Deposits are non-refundable
Payment is required to secure services and production dates
All sales are final
Late payments may delay services or delivery. Initiating a chargeback or payment dispute without prior communication constitutes a breach of these Terms.
7. Cancellations, Rescheduling & Force Majeure
Cancellations or rescheduling requests must be submitted in writing. Availability for rescheduling is not guaranteed.
Modern Memoir is not liable for delays or failure to perform due to circumstances beyond reasonable control, including but not limited to illness, injury, severe weather, acts of God, government restrictions, or equipment failure. In such cases, reasonable efforts will be made to reschedule.
8. Creative Discretion
You acknowledge that filmmaking is a creative and subjective process. By engaging Modern Memoir, you confirm that you have reviewed our portfolio and trust our artistic style and judgment.
Creative decisions regarding storytelling, editing, music, pacing, and final presentation are made at our discretion. Differences in personal taste or aesthetic preference do not constitute non-performance or grounds for refunds or revisions beyond the agreed scope.
9. Licensing & Usage Rights
All footage, audio, edits, and deliverables created by Modern Memoir remain the intellectual property of Modern Memoir unless otherwise agreed in writing.
Clients are granted a limited, non-transferable, non-commercial license to use their final film for personal purposes only. Clients may not re-edit, alter, sell, license, or use the film for commercial purposes without prior written consent.
10. Portfolio Use & Media Release
By engaging Modern Memoir, you grant permission for Modern Memoir to use your name, likeness, image, voice, and excerpts of your film for portfolio, website, social media, advertising, and promotional purposes.
You waive the right to inspect or approve final marketing uses and acknowledge that no additional compensation is owed beyond the agreed Services.
11. Confidentiality & Sensitive Content
Modern Memoir treats personal stories with care and professionalism. However, you acknowledge that absolute confidentiality cannot be guaranteed, particularly in digital environments, and disclosures may be required by law.
Modern Memoir is not liable for unauthorized access or disclosures beyond reasonable security measures.
12. Testimonials
Any testimonials, reviews, or feedback you provide may be used for marketing and promotional purposes. Testimonials may be edited for clarity while preserving their original intent.
13. Third-Party Content
The Site may contain links to third-party websites or resources. Modern Memoir does not control, endorse, or assume responsibility for third-party content, services, or privacy practices.
14. Disclaimers
